女职工特殊保护专项集体合同
COLLECTIVE CONTRACT ON PROTECTION OF FEMALE EMPLOYEES
女职工25人以上的企业应签订女职工特殊保护专项集体合同。在一些尚不具备单独签订专项集体合同条件的企业,可先以集体合同附件的形式对女职工特殊保护作出规定,待条件成熟时再签订女职工特殊保护专项集体合同。
Company with 25 female employees above must sign the Collective Contract for Special Protection of Female Employees. If with not more than 25 female employees, regulations for special protection of female can be the annex of company collective contract till it should be a Special Collective Contract for Protection of Female Employees.
第一条 本合同由___ (单位)与___ 工会根据中华人民共和国《劳动法》、《工会法》、《女职工劳动保护规定》、《女职工劳动保护办法》等法律法规以及省、市有关条例规定,为维护和保障女职工的合法权益和特殊利益,经平等协商后签订。
Article 1 This contract is made between ___ and___ , according to relevant and applicable Labor Law, Law of Trade Union, Regulations on Labor Protection for Female Employees, Law of Labor Protection for Female Employees of as well as other related regulations. It is signed after equal negotiation of both parties, subject to maintain and protect the rights and special interests according to the laws for female employees.
第二条 企业依法保障女职工合法权益。
Article 2 The company protects the rights and interests of female employees according to the law.
1.企业保障女职工获得平等的劳动权益,实行同工同酬。
Company ensures female employees of equal labor rights and interests, carrying out the equal pay for equal works policy.
2.企业应逐步提高企业职工代表大会中女代表的比例,使之与女职工比例相适应。
Company gradually enhances the portion of female employees in Company Employees Representative Convention to make it balance the total female employees’ portion.
3.企业吸纳工会女职工委员会代表参与制定及修改涉及女职工权益的规章制度、参与平等协商和签订集体合同的全过程。
Company accepts the representatives of Female Employees Representative Convention of Trade Union to participate in the establishment and revision of the rules and regulations related to females’ rights and interests, to participate in the whole process of peaceful consultation and signing of the collective contract.
4.企业严格执行劳动部颁发的《女职工禁忌劳动范围的规定》。
Company shall strictly implement the regulations on the working scope banned for female employees issued by the Ministry of Labor.
5.企业应按国家有关规定落实女职工孕期、产期、哺乳期的休息休假及待遇。
Company shall ensure the breaks and benefits of female employees during the period of pregnancy, production and lactation according to relevant laws and regulations.
6.企业应对女职工节育手术假、孕期产前检查、产假、哺乳期内的哺乳时间视同提供正常劳动并支付其工资。女职工按有关规定享受的产前假、哺乳假期间的工资不得低于百分之八十。
Company shall regards the female conception control holiday, prenatal examination time, maternity leave and lactation time during the lactation period as the working hours and pay it accordingly. The payment during the prenatal leave and lactation time shall not be less than 80% of previous one.
7.企业不得在女职工孕期、产期和哺乳期内解除其劳动合同,劳动合同期满也应自动延续至哺乳期结束为止。
Company is not allowed to terminate the labor contracts during the period of pregnancy, production and lactation of female employees. During the aforesaid period, duration of the labor contract shall be extended automatically till the expiration of lactation terms when the labor contract expires.
8.企业应按照《职工生育保险管理办法》规定足额缴纳生育保险费,按规定支付生育医疗费、生育营养补贴、围产期保健补贴、生育津贴和计划生育手术费。对接受节育手术的女职工给予相关的假期,报销手术费用。
Company according to Measures on Maternity Insurance for Employees should pay full bearing insurance premium, bearing service fee, bearing nourishment allowance, confinement health care allowance, bearing allowance and contraception operation expenses. Company shall pay for the female employees’ contraception operation as well as allowing relevant holidays for rest.
9.企业应按照《人口与计划生育办法》,给予女职工相应的待遇。
Company shall provide female employees with relevant treatment according to Population and Family Planning Policy.
10.企业至少每两年组织女职工进行一次妇女病普查,并提供相应的费用和时间。
Company shall organize the examination of gynecologic disease at least every two years and afford relevant expense and time.
11.其他可协商的内容 Others for negotiations
第三条 本合同签订后,遇有不可抗力或企业经营状况发生重大变化,双方可协商修改合同,但每年只能一次。
Article 3 Since the signing date of the contract, it can be modified but only once every year, based on two parities’ negotiation when company suffers from force majeure or big changes.
第四条 本合同有效期为 年,于 年 月 日起至 年 月 日止。并于期满前三个月内进行下一轮女职工特殊保护专项集体协商。
Article 4 The validity of the contract is ___Y(s), starting from ____ to ____. The parties shall start the next around of collective consultation for special protection to female employees 30 days before the expiration.
第八条 本合同签订后,企业应在10日内报送当地劳动保障行政部门审查。劳动行政部门自收到本合同之日起十五日内未提出异议的,本合同即行生效。
Article 5 The contract should be delivered to local labor guarantee bureau for censoring within 10 days since its signing. The contract will come into effect if no exception from local labor guarantee bureau within 15 days since it gets the contract.
生效的合同一式四份,双方各执一份,一份由劳动保障行政部门存档,一份报上级工会备案,并在10日内向全体职工公布。
The contract is made in four copies, each party holding one, Labor and Social Security Bureau and the superior trade union holding one each and should be announced to all employees within 10 days.
